Welcome to the DBDCompNet privacy policy ("Policy"). This policy exists for the purpose of transparency and how we process your information and work to protect your privacy.
1. Scope and Services
1.1 Scope of Policy
This applies when you ("user") use our Services (defined below) offered by the DBDCompNet Management or any of its affiliates or partners (referred to as "we", "our"), unless an affiliate has published their own privacy policy.
The terms of this policy together with our Terms of Service applies to your use of the Services. In certain circumstances, we may provide additional privacy-related information. This policy supplements such other notices.
1.2 Definition of Services
This policy gives you information on how we collect, use, process and disclose Personal Data that you provide us through the usage of our websites, applications and your DBDCompNet Account, social media channels and user support and other services that the DBDCompNet provides, which may be downloaded or streamed onto your device (the "Services").
2. Data Collection
2.1 Type of Personal Data
We may collect, use, store and share different kinds of personal data about you. This data contains following:
- Contact Data: email address.
- Content Data: includes information stored on your device, including login information.
- Employment Data: includes any personal information that you provide or attach to application documents and messages for positions at the DBDCompNet Staff.
- Identity Data: legal names, usernames or similar identifiers (identification codes of the platform you use).
- Marketing/Communication Data: includes your preferences receiving marketing and advertisement from us and affiliated parties and how we can communicate with you.
- Profile Data: includes your username, password, registered organizations, survey responses containing personal data, information you provide when contacting our support services, including other information that you share with us by using our Services.
- Technical Data: includes internet protocol (IP) address, your general (but not precise) location, login data, browser and plug-in information, time zone, operating system and platform, and other technology on the devices you use to access our Services.
- Usage Data: includes information, preferences and statistics about how you use our Services.
(all collectively referred to as "Personal Data").
We may also collect, use, store, and disclose Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your Personal Data but is not considered Personal Data as this data will not (directly or indirectly) reveal your identity.
We do not collect any Specific / Special Categories of Personal Data about you (including details as follows):
- race or ethnicity,
- religious, political or philosophical beliefs,
- sexual orientation,
- health information,
unless you provide your express consent.
2.2 Failing to Provide Personal Data
When we are required to collect Personal Data by law, or under the terms of a contract we have with you or you want to make with us, and if you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, as necessary to be able to provide you with the Services). In that case, we must cancel the Services and/or you may be unable to use certain Services or features.
3. Our Use of your Data
3.1 Purpose for which we use your Personal Data
Below is a description of how we may use your Personal data (GDPR Art. 12).
- Performance a contract with you (Art. 6 No. 6 (b) GDPR): your DBDCompNet account, to manage our relationship with you, to enable your participation in a survey or contest, to administer the Services, provide you with technical support, to review and process your application, to provide and operate the Services including to put you in touch with other players (communication), to share your provided information with our members and partners and affiliates and to function the DBDCompNet System ("Discord Bot") across all Discord server organizations.
- To comply with legal obligation (Art. 6 No. 1 (c) GDPR): for administrative or judicial authorities for the purposes of an investigation, to comply with law, regulation, or legal process to protect and enforce the safety and security of any person, or their rights, to address security issues and criminal activities.
- Your consent (Art. 6 No. 1 (a) GDPR): to deliver relevant content and personalized/targeted advertisements to you, to provide you with features, content or ads in accordance with your interests and preferences, to enable your participation in a draw, contest or survey.
- Legitimate interest (Art. 6 No. 1 (f) GDPR): protecting our business (including troubleshooting, fraud prevention, managing player bans, updates, system testing, IT services, network security).
3.2 Opting out and changing purpose
You can ask us to stop sending you marketing and advertising messages at any time (Art. 6 No. 1 (a) GDPR). Opting out of receiving marketing communication will not impact Personal Data provided to us as a result of a service.
3.3 Exempt to Use Your Data for other purposes
We are only using your Personal Data for the purposes that we stated in this policy. If we need to use your Personal Data for another purpose, we will notify you and explain the legal basis for why we're doing so. Where it's required or permitted by law, we may process your Personal Data without your knowledge or consent.
4. How is Your Personal Data Collected
We use different ways to collect Personal Data from you including through:
4.1 Direct interactions
We receive information about you through direct interactions when you:
- Apply for our Services, subscribe to newsletters, and when you register for Services (including registering a team) or when you become a beta tester;
- Create an account (or profile) for our Services;
- Enter a contest, event (tournament) or survey or create content as a user of our Services (forum);
- Contact our user support, request technical assistance, give us feedback or apply for an available position of ours.
4.2 Data Available Publicly
You may provide Personal Data when you publish it on public areas of our Services or send it directly to other users using our Services or to third parties (collectively, "User Contributions"), as part of blogs, discussion platforms, public user profile or other similar forums on our Services, such as chats ("Forums"). The data you disclose in the Forums becomes public data and may be read or used by other users of the Services. We are unable to control the actions of other users with whom you chose to share your User Contributions. If you do disclose Personal Data on public areas, you do so at your own risk and we are not responsible for the use of such Personal Data by third parties.
4.3 Automated Technologies, Cookies, Analytics Metric Tools and Other Technologies (Cookies Clause)
We use automated technologies and tools to collect and process information about your use of our Services. These technologies help us operate, maintain, improve, and secure our Services, as well as understand how users interact with them.
Such technologies may include cookies, web beacons, pixels, software development kits (SDKs), log files, and analytics and metrics tools. These technologies automatically collect technical and usage data, which may include your IP address, device identifiers, browser type, operating system, referring URLs, pages viewed, dates and times of access, and interaction data.
Cookies may be session cookies, which are deleted when you close your browser, or persistent cookies, which remain on your device for a defined period or until deleted. We use cookies and similar technologies for purposes such as enabling core functionality, remembering preferences, improving performance, measuring audience engagement, and detecting and preventing fraud or misuse.
Where required by applicable data protection and ePrivacy laws, we use non-essential cookies and similar technologies only with your prior consent. You may withdraw or modify your consent at any time through your cookie preferences or browser settings. Please note that disabling certain cookies may affect the functionality of our Services.
Processing carried out through analytics and metrics tools is based on our legitimate interests in understanding and improving our Services (Article 6(1)(f) GDPR), unless consent is required under applicable law, in which case processing is based on Article 6(1)(a) GDPR.
4.4 Third parties
We may receive Personal Data about you from various third parties, we describe it below:
- Service Providers, such as affiliates, vendors and contractors that perform Services on our behalf;
- Publicly available sources, such as public posts and comments on third-party social media platforms and websites;
- Business partners and clients ("Members"), such as partners with whom we have collaborated to provide Services to you or when we perform services on behalf of a client ("Member");
- Advertising partners that run advertisements on our Services;
- Other third parties when you have agreed that they share certain Personal Data about you with us (including authentication partners or third-party platforms you chose to connect to our Services with.
Personal Data may be combined with information we already receive from you directly.
5. Disclosure of your Personal Data
We may share your Personal Data with third parties, as listed below, for the purposes described in section 3. In certain cases, we will ask for your permission before sharing your Personal Data with third parties, if required by applicable laws.
5.1 Our third parties
All Members of the DBDCompNet, who are based across the globe may have access to your Personal Data for purposes of providing the Services that they offer, if they do use your Personal Data over our Services, they will do so in compliance with this Policy and additional policies by them, but always with this Policy as base.
DBDCompNet Admins, as defined per Terms of Service Agreement ("Terms"), including but not limited to organizations with an Access Agreement ("non-Member") have access to your information like our Members.
5.2 External third parties
We do not share your Personal Data with any external third party, unless:
- Fraud and Legal: BHVR Inc. requests your data due to legal reasons, fraud to the business and/or other users, scamming other users in the name of BHVR to cause harm. (Art. 6 No. 1 (a); Art. 6 No. 1 (b) GDPR)
- Law enforcement: Authorities or affiliated with the authorities' persons request your data for law enforcement purposes. (Art. 6 No. 1 (c) GDPR)
In the case that a person requests insight on your Personal Data, that is not using reasoning said here, we will ask you prior before giving out any information. We will generally deny such requests.
6. Location of your Personal Data
Personal Data may be hosted and processed, for the purposes of this Policy, on servers operated by trusted partners or service providers in Europe, such as IONOS SE.
If you are based in the European Union, this may involve transferring your Personal Data outside the UK or the European Economic Area ("EEA"). If you are based in Canada or US, this may involve transferring your Personal Data outside Canada or US. Some of our external third parties are based outside of these jurisdictions so their processing of your Personal Data will also involve a transfer accordingly. Whenever Personal Data is transferred from the EEA, UK, Canada or US to a location outside of these jurisdictions (as applicable), we ensure a similar degree of protection is afforded to it. As applicable, we may use specific contracts approved by the European Commission or the UK Information Commissioner's Office which give Personal Data the same protection it has in Europe and/or the UK.
7. Duration of your Personal Data
We keep your Personal Data strictly only for the period that it is required for, such as maintaining your DBDCompNet Account, as well as for the purposes of satisfying any legal, or reporting requirements.
We may anonymize your data in some circumstances, which makes them no longer associated with you, to issue research or statistical actions, in which case we may use this information indefinitely without notifying you any further. Otherwise, we will delete your Personal Data immediately.
8. Safeguarding your Personal Data
The DBDCompNet Management is taking different measures to protect your Personal Data from abuse and misuse.
All information, as stated in section 6, is stored securely. Once we have received your information, we will use strict procedures and security features to protect your Personal Data from being accidentally lost, used or accessed in an unauthorized way.
We will collect and store Personal Data on your device using application data caches and other technology.
If we encounter, by automatic procedures and systems, that when a Personal Data breach was discovered, we will immediately inform you and regulators where we are legally required to let them know.
We are not responsible for circumvention of any privacy settings or security measures contained on our Services Sites. The DBDCompNet Management declines all liability if the Personal Data is subject to unauthorized use or access.
9. Your Rights
9.1 Your Legal Rights
By law, about data protection, you have the following legal rights:
Request access to your Personal Data: You have the right to request confirmation as to whether we process your personal data and, if so, to obtain access to that data and related information.
Request correction of your Personal Data: You have the right to request the correction of inaccurate personal data and the completion of incomplete personal data we hold about you.
Request erasure of your Personal Data: You have the right to request the deletion of your personal data where there is no lawful reason for us to continue processing it.
Object to processing of your Personal Data: You have the right to object to the processing of your personal data where such processing is based on our legitimate interests or for direct marketing purposes.
Request restriction of processing your Personal Data: You have the right to request that we limit the processing of your personal data under certain circumstances, such as while we verify its accuracy or assess an objection.
Request transfer of your Personal Data: You have the right to request the receipt or transfer of personal data you have provided to us in a structured, commonly used, and machine-readable format.
Right to withdraw consent: You have the right to withdraw your consent at any time where we rely on your consent to process your personal data, without affecting the lawfulness of processing before withdrawal.
You also have the right to ask us to not continue using and processing your data for marketing purposes, and to appeal any adverse decisions made by us regarding the processing of your Personal Data. In the event your consent was expressly provided to the DBD Comp Union or its members for ads personalization in our management Services ("DBD Competitive Network") you may withdraw your consent as indicated in the related Services.
9.2 Exercising your Rights and Fees
You will not fall under any fees to exercise your legal rights above. We entirely refuse any fees for exercising your Rights, even if we are legally allowed to.
To exercise your rights and ensure that the exerciser and target are the same person, we may have to ask you a few questions and receive information from you to verify your identity and ensure your right to access your Personal Data, or to exercise any of your rights. This is a security measure to ensure that Personal Data is not disclosed to any person who is not allowed to receive that information.
9.3 Additional Rights
Some other states may allow additional rights or different rights from the ones the European Union has issued. If you would like to execute those, contact us under support@dbdcompnet.com. We will follow any data protection law that we are to comply with when offering our Services in those regions.
10. About Children
The Services provided by the DBDCompNet Management, whose targeted audience is Dead by Daylight, are not intended for children who are considered minors under the data protection law of their country of residence (a "Child"). No Child is allowed to provide any information on our Services. We do not knowingly collect Personal Data from Children. If you are a Child, do not use our Services or provide Personal Data on our Services, unless clearly allowed by your Legal Guardians If we learn about the collection of Personal Data from a Child without the Legal Guardian's consent, we will delete that information.
As stated above, the DBDCompNet Management will allow a Child to use our Services with the consent of a Legal Guardian or Parent. In those cases, the restrictions above do not apply.
11. Third-Party Links
Our Services may include links to third-party websites, plug-ins or applications. Clicking on those links or enabling connections to those products or Services by third parties, may result in you allowing third parties to collect, use and share your information and Personal Data. We do not control these third-party websites and are not responsible for their privacy statements. If you click on these Services, you will leave our Services and Policy about protecting your data.
Certain products and/or services are offered to you as part of our Services in partnership with third parties and you may be required to provide Personal Data to them to register and access their products or services. The identity of these third parties will be indicated at the time of registration. If you choose to register, you will transmit your Personal Data to these third parties, and their treatment will be subject to their privacy policy.
12. Direct Marketing Decision
We will only send you direct marketing communications by email or text if we have your direct consent or if you have requested information from us or used certain Services. We will get your direct consent before we share your Personal Data with any third parties for marketing purposes, including ads personalization.
You may withdraw such consent at any time or may object to the receipt of newsletters, or promotional emails by following the steps detailed in such communications.
13. Changes to the Policy
We update our Policy regularly. In the case we change this Policy, these changes will be posted on this page and displayed in red for 7 (seven) days, you will be notified by email or when you log onto the Services. The new policy may be displayed on-screen, and you may be required to read and accept these new terms of this ("Privacy Policy") policy. If you do not accept these terms, in accordance with our ToS ("Terms of Service"), we will have to terminate your account ("DBDCompNet Account") with us. We require an active agreement from you.
